क्योकि बिल्डर द्वारा रेलव से पानी को नीचे से निकलने की सहमति ले ली गयी है उसके तहत बिल्डर को कुछ शुल्क रेलवे में जमा करना है।जिसे जल्द जमा करवाने का प्रयास टीम ए. ओ.ए कर रही है।

साथ ही साथ कल नगर निगम व Gda के अधिकारियों द्वारा साइट विजिट की गयी है।इस काम को जल्द से जल्द पूर्ण करवाने का प्रयास जारी है।जिससे हमारी समस्या को दूर किया जा सके।

Respected Sir,

 

1.      Kindly refer to my requests dated 15th November, 2014; 29th November, 2014; 30th December, 2014; 1st January, 2015; 3rd January, 2015; 27th April, 2015; 13th June, 2015; 21st July, 2015; Speed Post letter dated 1st September, 2015; 2nd March, 2016; 6th June, 2016; 2nd September, 2016; 10th March, 2017; 7th June, 2017; 6th September, 2017; 29th November, 2017; 20th February, 2018 and 1st April, 2018 on the above subject.  I am, once again, requesting for the same.

 

2.      Mahagun Group : Mahagun India Private Limited (Mahagun Real Estate Private Limited) started booking of Flats for their Project 'Mahagunpuram' at NH-24, Mehrauli, Ghaziabad – 201002, Uttar Pradesh with effect from May, 2009 onwards.

 

3.      Registry and Physical Possession of the Flats by the residents of Mahagunpuram, NH-24, Mehrauli, Ghaziabad – 201002, Uttar Pradesh had been done with effect from November, 2012 onwards and majority of the residents have done their Registry from Registration Office (Office of the Treasury, Ghaziabad), Tehsil, Ghaziabad, Uttar Pradesh and also taken Physical Possession of their Flats from the Builder by March, 2013 by paying all the Payments/Charges/Taxes, Stamp Duty, etc due to be paid by residents [as intimated (in writing) by the Builder :  Mahagun Group : Mahagun India Private Limited (Mahagun Real Estate Private Limited)] to all the concerned Agencies {including Mahagun Group : Mahagun India Private Limited (Mahagun Real Estate Private Limited); Central Government, State Government of Uttar Pradesh; Registration Office (Office of the Registry, Ghaziabad), Tehsil, Ghaziabad; etc}.


4.      Also, our MP-AOA [Mahagunpuram Apartment Owners Association], Mahagunpuram, NH-24, Mehrauli, Ghaziabad – 201002, Uttar Pradesh] had been registered with the Competent Authority in December, 2013.

 

5.      It is also hoped that Mahagun Group must have taken all the required clearances/completion certificate for the Project 'Mahagunpuram' from all the concerned Agencies (Central Government, State Government of Uttar Pradesh; Ghaziabad Development Authority; Ghaziabad Nagar Nigam; Uttar Pradesh Jal Nigam; Ghaziabad Jal Board; etc) before the Registry of the Flats / Physical Possession of the Flats to the residents of Mahgunpuram, so that Sewer Line Connection should have been provided to the residents of Mahagunpuram, NH-24, Mehrauli, Ghaziabad – 201002, Uttar Pradesh.

 

6.      Till date, no Sewer Connection has been provided to the residents of Mahagunpuram, NH-24, Ghaziabad, Uttar Pradesh even though the residents of Mahagunpuram have taken physical possession of their Flats after Registry and also by paying all the dues/stamp duty to the concerned agencies [as told to the residents by the Builder at the time of Registry/Physical Possession of the Flats at Mahagunpuram].  Due to no Sewer Line Connection, the problem of water-logging happens regularly in Mahagunpuram.

 

7.      Shri S.S. Verma, Officer of Ghaziabad Development Authority (GDA), Vikas Path, Ghaziabad had addressed a letter dated 27th December, 2014 (copy attached) to Shri Amit Jain, Director, Mahagunpuram, NH-24, Mehrauli, Ghaziabad (with a copy of it to me for information) forwarding therewith my request on the above subject to him with directions to him to solve the problems being faced by the residents of Mahagunpuram, NH-24, Mehrauli, Ghaziabad on the above subject at his level.

 

8.      On 02 January 2015, I had also received a reply from the Office of Vice Chairman, Ghaziabad Development Authority (GDA) [helplinegda@gmail.com], as under :-

 

"Regarding this matter, please contact – 9711364673 Shri S.S. Verma, Officer, GDA".

 

9.      After receiving the above reply dated 02 January 2015, I spoke with Shri S.S. Verma, Officer, GDA on 3rd January, 2015.  He told me that he had already given directions by writing a letter to Builder on 27th December, 2014 (copy attached) for solving the problems being faced by the residents of Mahagunpuram, NH-24, Mehrauli, Ghaziabad regarding 'providing Sewer Line Connection' for the residents of Mahagunpuram.

 

10.    Ghaziabad, Uttar Pradesh is already an 'NCR (National Capital Region) City' since 1985 and the cities which comes under 'NCR' should have all the same common excellent facilities/infrastructure, like Excellent Roads/Widened Highways connected with Delhi and other NCR Cities; Common Transport System [Bus (DTC, UPSRTC, Autos, taxis, cabs, etc), Rail, Metro Extensions, etc) with Delhi and other NCR Cities; Safe Drinking Water for all; Sewer Connections for all; 24 Hour Electricity for all; etc. 

 

11.    On 27 August 2015, Central Government releases list of 98 Smart Cities which also includes Ghaziabad, Uttar Pradesh as a 'Smart City'.  Smart City 'Ghaziabad, Uttar Pradesh' will realize the dream of the perfect life.  The motive of each Smart City is one to accelerate economic growth and provide a better life to the citizens of the Smart City which includes sufficient water supply/water management; 24 hours power; affordable housing; pure climate; sanitation; waste management; sewer connections; better public transport (road, rail, metro, autos, taxis, cabs etc); digitization, e-governance; e-hospital (medicine, providing treatment and medical advice online, via the internet and smartphones make people aware of diseases); improved traffic; civil protection; education; health, etc.

 

12.    Ghaziabad, Uttar Pradesh is an 'NCR City' since 1985 through 'The National Capital Region Planning Board Act, 1985' published in 'The Gazette of India' on 11th February, 1985 and now it is also declared as a 'Smart City' by the Central Government on 27 August 2015, it should have all the excellent facilities as mentioned in Paras 10 and 11 above for all the citizens residing in Ghaziabad, Uttar Pradesh.

 

13.    President and Secretary of Apartment Owners Associations Federation Ghaziabad (AOAFG) [Regd] also wrote a letter dated 4th September, 2015 (copy attached) to Ghaziabad Development Authority (GDA) regarding providing Sewer Line Connection for the residents of Mahagunpuram. 

 

14.    Newspaper cutting of the meeting held on 2nd February, 2016 (copy attached) of President, Apartment Owners Associations Federation Ghaziabad (AOAFG) [Regd] and President / representatives, Mahagunpuram Apartment Owners Association (MP-AOA) [Regd] with Vice Chairman, Ghaziabad Development Authority (GDA) regarding Sewer Line Connection for the residents of Mahagunpuram is attached for information and further necessary action please.

 

15.    Also, kindly refer to meeting of 16th September, 2016 (photograph of the meeting attached) on the above subject with Vice Chairman, Ghaziabad Development Authority (GDA) in which Executive Members of Mahagunpuram Apartment Owners Association (MP-AOA) [Regd.] and Col Tejandra Pal Tyagi, President, Apartment Owners Associations Federation Ghaziabad (AOAFG) [Regd] took part for an early sanction of 'Sewer Line Connection' for Mahagunpuram, NH-24, Mehrauli, Ghaziabad (Uttar Pradesh). 

 

16.    On 10 March 2017, I had received a reply from Shri Mohd Mohsin Farooqui, Computer Cell, Urban Development Department, Government of Uttar Pradesh, Room No. 836, Bapu Bhawan, Uttar Pradesh Secretariat, Lucknow – 226001 (cc.urbandev@gmail.com) addressed to me and to the Secretary and Officer on Special Duty, Urban Development Department, Government of Uttar Pradesh, Room No. 834, Bapu Bhawan, Vidhan Sabha Marg, Lucknow – 226001 (awasbandhu@gmail.com), as under :-

 

"I am directed to inform you that the matter is related with Housing and Urban Planning Department. The same has been forwarded to them for necessary action".


17.    Kindly refer to letter dated 02 May 2017 (copy attached) of Shri RP Singh, General Manager (T) / Project Director, National Highways Authority of India (NHAI) [Ministry of Road Transport & Highways], Project Implementation Unit, Ghaziabad, House No. 518, Niti Khand – 1, Indirapuram, Ghaziabad – 201014 (Uttar Pradesh) addressed to the Vice Chairman, Ghaziabad Development Authority (GDA), Ghaziabad (Uttar Pradesh) regarding 'permission for the access to the drainage system of proposed NH–24'.

 

18.    Kindly refer to letter dated 20 June 2017 (copy attached) of GDA addressed to the concerned authorities with copies of it to MP-AOA / Builder / other concerned authorities regarding Sewer Line Connection for Mahagunpuram and also intimating convening of meeting on 24 June 2017 at 1230 hours with Vice Chairman, GDA on this subject.

 

19.    In the meeting held on 24 June 2017 at GDA Conference Room between representatives/officers of MP-AOA, Builder and GDA, the following actions on this subject were decided to be taken at the earliest, as under :-

 

"आज दिनांक 24 जून 2017 को जीडीए के सभागार में माननीय उपाध्यक्ष द्वारा महागुन पुरम में ड्रैनेज/निकासी की समस्या के हल के लिए बिल्डर महागुन रियल एस्टेट प्राइवेट लिमिटेड, महागुन पुरम एसोसिएशन जीडीए के उच्च अधिकारीगण की मीटिंग बुलाई थी |

 

जिसमें जीडीए की तरफ से श्री आर के जायसवाल अधीक्षण अभियंता, श्री कप्तान सिंह अधिशासी अभियंता प्रभारी - प्रवर्तन विभाग।

 

महागुन की तरफ से श्री एस सी शर्मा वाइस प्रेसिडेंट कमर्शियल, श्री प्रदीप कुमार शर्मा आकाश जैन।

 

महागुन पुरम एसोसिएशन की तरफ से श्री ईश्वरचंद जिंदल अध्यक्ष, श्री गौरव द्विवेदी महामंत्री, श्री शीतल त्यागी पूर्व अध्यक्ष, श्री ओम पाल सिंह ,श्री उत्तम राणा श्री जेपी चंद्रा उपस्थित थे।

 

लगभग एक घंटा चली इस मीटिंग का परिणाम निम्नलिखित रहा

 

जीडीए ने स्पष्ट रुप से बताया, बिल्डर द्वारा दिए गए शपथ पत्र के आधार पर महागुन पुरम प्रोजेक्ट की स्वीकृति नो वाटर डिस्चार्ज शर्त के ऊपर दी है। इसको बिल्डर के प्रतिनिधियों ने स्वीकार किया। 

 

बिल्डर ने बताया 10 करोड़ रुपया ईडीसी के रूप में जमा किया है और यह जिम्मेदारी जीडीए की है कि वह ड्रेनेज की व्यवस्था करा कर दें |

 

जीडीए ने कहा कि वह ड्रेनेज बनाने के लिए तैयार हैं, परंतु प्रोजेक्ट अप्रूवल के समय लगाई गई शर्तों के अनुसार जो भी खर्चा होगा वह उसमें से ईडीसी का पैसा काट कर बाकी बिल्डर को देना होगा। आज के दिन ड्रेनेज बनाने के लिए भूमि अधिग्रहण अन्य खर्चों में लगभग 550 करोड़ रुपए की अनुमानित लागत है, जिसमे ईडीसी का पैसा काट कर बाकी का बिल्डर को देने होगे।

 

जी डी ने बताया, समस्या के हल के लिए एक सलाहकार की भी नियुक्ति की गई है। साथ ही एनएचएआई के अधिकारियों से भी संपर्क किया गया है ताकि कोई व्यवस्था बनने वाले एनएच-24 में हो जाये।

 

बिल्डर ने बताया, एसटीपी से निकले पानी के डिस्पोजल पर अब तक लगभग डेढ़ करोड़ रुपया खर्च हो चुका है। उन्होंने यह भी स्वीकार किया जब तक ड्रेनेज की व्यवस्था नहीं हो जाती है, तब तक जो भी खर्चा उसके डिस्पोजल पर आएगा वह बिल्डर वहन करेगा।

 

जीडीए ने बिल्डर को यह निर्देश दिया, अगले 15 दिनों के अंदर बिल्डर  ड्रेनेज की समस्या के समाधान हेतु कोई समग्र प्रस्ताव प्रस्तुत करें। अगली मीटिंग 15 दिन बाद होगी।

 

साथ ही, कंप्लीशन सर्टिफिकेट पर बताया गया कि वर्तमान ड्रेनेज समस्या के चलते बिना आरडब्ल्यूए को विश्वास में लिए सर्टिफिकेट जारी किए जाने की कोई संभावना नहीं है।"

23.    Kindly refer to letter dated 23 September 2017 (copy attached) of Secretary, GDA addressed to the Office of Hon'ble Chief Minister of Uttar Pradesh, Lucknow relating to Sewer Line Connection for Mahagunpuram.  Mahagunpuram colony is developed by the Private Builder with the approval of GDA and it is understood that 'any colony developed with the approval of GDA has to be provided with proper Sewer Line Connection by the concerned authorities of State Government'. 

 

24.    The present sewage treatment plant installed by Private Builder is not working properly and black water with filthy smell is there while using the water for flush purposes.  Moreover, it is very costly affair to take remaining residual sewage water by private agencies through water tankers for any other purposes outside Mahagunpuram colony.  Till date, crores of rupees have been spent by Private Builder (as per Para 19 above) for maintaining the sewage treatment plant and also for disposing-off the remaining residual sewage water outside the Mahagunpuram colony by private agencies through water tankers without any Sewer Connection at Mahagunpuram which is increasing the Maintenance Cost for all residents of Mahagunpuram.  This is not the permanent solution to the problem and it will also always increase the Maintenance Cost for all the residents of Mahagunpuram thereby unnecessary further burdening them with very high cost of maintenance at Mahagunpuram colony.  By providing Sewer Connection at Mahagunpuram colony, crores of rupees (as per Para 19 above) will be saved which is presently being spent for disposing-off the residual sewer water through private agencies through water tankers and optimum utilization of resources will also take place.  It will also help in reducing the Maintenanace Charges being paid by the residents of Mahagunpuram.

 

25.    Kindly refer to letter dated 18 May 2018 (copy attached) addressed to Vice Chairperson, Ghaziabad Development Authority (GDA), Ghaziabad from MP-AOA (Mahagunpuram Apartment Owners Association, NH-24, Mehrauli, Ghaziabad) regarding providing of Sewer Line Connection for Mahagunpuram, NH-24, Mehrauli, Ghaziabad.

 

26.    Also, kindly refer to the meeting held on 29 May 2018 between DM, SDM, officers/officials of Ghaziabad Development Authority (GDA), National Highways Authority of India (NHAI) and Executive Members of MP-AOA (Mahagunpuram Apartment Owners Association, NH-24, Mehrauli, Ghaziabad) regarding providing of Sewer Line Connection for Mahagunpuram, NH-24, Mehrauli, Ghaziabad.  It was promised on 29 May 2018 to MP-AOA by the concerned Officers/Officials that the Sewer Line Connection for Mahagunpuram will be provided soon.  Comments dated 29 May 2018 of MP-AOA are as under :-

 

"NHAI, GDA एवं प्रसाशन ने स्थिति स्पष्ट करते हुए आज की मीटिंग में ड्रेनेज देने का वादा किया हैं" 

 

27.    In view of the above, it is requested that necessary instructions may please be issued to the concerned officers/officials so that the residents of Mahagunpuram, NH-24, Ghaziabad may please be provided 'Sewer Line Connection' at the earliest by the Builder (Mahagun Group) / Ghaziabad Nagar Nigam (Ghaziabad Municipal Corporation) / Ghaziabad Development Authority (GDA) / National Highways Authority of India (NHAI) as already considerable delay has occurred in this regard.  We all will be highly grateful to you for that.
