As per the schedule for annual elections of MP-AOA, We hereby announce
the election for the Governing Body of MP-AOA under the Uttar Pradesh
Apartment (Promotion of Construction, Ownership and Maintenance) Act-
2010

ELIGIBILITY FOR CONTESTING ELECTIONS AND VOTING RIGHTS
a. As per the Act only the owner or the co‐owner will be entitled to
become the member of the association and can submit his/her nomination
to contest election.
b. To contest election, the member should be resident of Mahagunpuram and
he/ she should be staying in the Mahagunpuram.
c. Votes will be cast in person by the Registered Member of MP-AOA. In case
member is not available, his/ her spouse can cast the vote.
d. Voters will have to show Identity Cards, being issued combindly by AOA and
CSK, at the verification/checking counters.
e. Owner or co‐owner of the apartment and residing in can nominate himself
or herself by filling the nomination form and providing requisite documents
as mentioned in the form and submit the same to the Election Committee
in sealed envelope as per the election schedule.
f. Nomination should also be proposed and seconded by two different
Registered Members. The proposer member cannot propose two candidates
for the same post.
g. No apartment owner is entitled to vote or nominate himself/herself on the
election of members of the Board or entitled to stand for election to such
office, if he/she is in arrears, of any sum due from him/her in respect of
his/her contributions for common expenses, for more than sixty days on the
last day of the year preceding the year in which the election to Board would
take place.
h.He/She should be of 18 years or more.
i.He/She should be of the sound mind.
j.He/She should not be declared as insolvent
k. He/She is not convicted by any court of law.
l. As per Bye Laws, no member shall be eligible for election if he/she has
been found guilty of misusing the post during his/her previous terms.
ELECTION PROCEDURE
a. Every First allotte of the flat shall have one vote per flat for all purpose. Votes
will be cast in person.
b. The Election Committee along with Apartment owner's association is
committed to take all measures to ensure fair & proper elections procedures
for formation of Governing Body.
c. Election Committee will accept or reject the application of nominees for
Governing Body in case of default & providing incomplete information or in
case of non‐eligibility as per the guidelines of the Act mentioned in the
eligibility criteria above.
d. MP-AOA will have a total of 10 members (including one Builder's nominee) in
its Board of Management (Executive Body of MP-AOA)
e. Counting will be conducted, same day, immediately after conclusion of voting.
f. Candidate or one nominee from him/her will be allowed inside the Counting
room during the counting.
g. In case of tie between two nominees, winner will be decided by draw
h. The elected members will hold their first meeting within 10 days from
declaring the results and elect the office bearers of different boards.

ELECTION CODE OF CONDUCT
a. Existing AOA will remain functional till the formation and handover to the new
elected Governing Body. The existing AOA will desist from taking any
new policy decisions. However all day to day activities including
maintenance will be taken care off.
b. No Individual, either part of the current Governing Body or newly
nominated candidates will use common Email/Messaging Group as a
platform, in any capacity, to highlight individual's efforts or achievements
or personal agenda.
c. Existing AOA members must, in all cases, will use the official AOA Email Id
for sharing any update or information with the general residents in the
society.
d. No Candidate can use defamatory remarks against individuals or the current
body of representatives at any platform.
e. No Candidate will invite or involve any third party or outsider to promote
his/her election campaign.
f. No candidate can indulge in his/her individual capacity in any financial
transaction, whatsoever, in cash or in kind, neither in any common society
functions and activities nor in convincing or commuting the voters to vote.
g. No candidate should spoil the society premises by putting posters or
hoarding or banners
h. Election campaign must end 24 hours prior to the date of election
i. Voting timings will not be extended in any circumstances
j. If anybody found violating any of the above mentioned rules in code of
conduct, his/her nomination will be cancelled with immediate effect from
the point it has brought in to notice of Election committee.
