Hi,
Viddhi Tower (facing Tanushree Palace) residents are facing Sleepless night due to late
night very loud music playing at Tanushree Palace.
RWA please take some action to stop this loud music playing after 10:00 PM at Tanushree
Palace.
I believe Bhagirathi Tower residents facing the same issue
08 Feb 2014 Saturday night played very loud music till 01:05 AM
09 Feb 2014 Sunday night played very loud music till 01:02 AM
It is against the law too.
The court had ruled the "night" to mean an intervening period between 10 pm to 6 am where
a complete ban has been placed on playing loud music or making any type of noise.
The division bench of Chief Justice Arun Kumar Mishra and Justice Bela M Trivedi has
directed the state authorities to seize the music system or the orchestra used to play
loud music after 10 pm on rooftop restaurants, open places or at marriage halls. The
division bench has further directed that no licences shall be issued to those marriage
gardens who do not have adequate parking facilities of their own. These directions came
on a PIL filed by one P K Mathur.
The traffic police has been directed not to allow any obstruction of traffic during
marriage season. It has further been mandated by the high court that challans should be
filed against the delinquent persons including the restaurant and the marriage hall
owners.
"It was brought to the court that the state government has already amended the noise
pollution control rules in 2008 and we have assured the court of strict compliance of the
same. Standing order will now be issued to the state police to register an FIR if any
complaint of noise pollution is received and the system will also be seized immediately
and the person will be produced before the court for taking appropriate punishment for
making loud noise in violation of laws," said S N Kumawat, additional advocate general.
Recently, the Union government made a similar provision in Central Acts prohibiting late
night noise pollution via amplifier, loudspeaker, music system etc. But there is still
scant knowledge of such a ban among common public and even the law enforcement machinery
of all the states have miserably failed to observe the provisions of Central Act as well
as the local noise control act.
