Dear Sir,
I would like to draw your kind attention to the following Order of Delhi High Court dated June8,2016 for your information, ready reference,compliance and necessary action at your end:
The Order:
If the Builder has collected any amount as Service Tax from the buyers for Taxable Service as defined in Section 65(105)(zzzh) of Finance Act 1994, and has deposited the same with the Govt. Authorities.
Any such amount deposited shall be refunded to the buyers with interest at the rate of 6% from the date of Deposit till the date of Refund.
In view of the said order of the Delhi High Court, I as President of Mahagunpuram Apartment Owners Association, hereby request you to arrange to refund the Service Tax already levied from us, at the earliest in due compliance of aforesaid orders of Delhi High Court.
