Once a developer starts the construction work in a group housing society, he is legally not entitled to get any additional FAR. Many developers, however, are being granted additional FAR at any various stages of construction.
According to compounding rules and public policies in Uttar Pradesh, some violations in a group housing society in the stilt area, fire refuge area, open/green area, basement and terrace area can't be compounded (that is, the violations cannot be regularized even if a developer is ready to pay a fine). In some developments, however, these violations have been compounded, the RWAs allege.
Unauthorised construction of shops, flats, extra floors, etc over and above the sanctioned/completion plan and compoundable limits have allegedly been overlooked by the authorities.
Community centres are renamed as commercial clubs to claim ownership by the promoter in contravention to the statute and restrictions of the master plan as per land use.
