Mahagunpuram: Wrongdoing of Mahagun in Mascot project

Sir,

Kindly note that the High-Rise towers Milano and Ferrara located in group housing 'Mahagun Mascot' is unsafe for human in habitation. The said towers lack the necessary open space/setback required for fire fighting. As per the National building Code and Ghaziabad building code the towers as high as Milano and Ferrara (60 meters 2 stories tall)need atleast 15 meters wide open space infront and on all its side. Additionally as per National Building Code the high rise towers Milano and Ferrara must abut on the outer road meaning that there shall be no obstruction between the tower building and the outer road. However due to the presence of the ILLEGAL SHOPPING COMPLEX , constructed right in-front of the said towers, the necessary open space in-front of the said towers is reduced to 6 meters only. The shopping complex is an illegality and its approval has been acquired by paying bribe money to Ghaziabad Development Authority. The space on which the shopping complex has been constructed has to be left open and by no stretch of imagination can any construction be raised over that space. As a result in the event of fire the residents of high rise towers Ferarra and Milano cannot be rescued by the Fire Fighting service. The fire tende cannot operate in the reduced space. For buildings as high as Milano and Ferrara at-least 15 meters is needed. There shall be heavy casualty (DEATH) in hundreds in these 2 towers. The recent fire in AMRI hospital in Kolkatta on 9 December 2011 where 93 people were sent to their death is a perfect example of how setback and open-space violation can result in deaths. AMRI hospital was just a 5 (FIVE) storey building, Imagine the death toll in 21 storey building. You may also read about CARLTON TOWERS Bangalore where setback/open-space violation resulted in huge death toll due to fire. You should also note that Mahagun has provided NO side setback (inter tower). As per laws atleast 15 meters has to be provided but only 1 meter has been provided instead. All the four towers (Verona, Ferrara, Milano and Bettina) have been shown as one single tower in the map/plan and with the aid of this misrepresentation the side setbacks have been done away with.

You think fire cannot effect you. Well think again, The people who died in AMRI Hospial kolkatta probably also thought the same.

Why should you sacrifice your life and your family member's life for the sake of builder's illicit profit? Why should your children die of burn injuries and suffocation so that a spineless corrupt GDA babu can make bribe money?

I have been fighting Mahagun since January 2011 in courts and have got reasonable success. The Hon'ble Ghaziabad Consumer court has restrained (stayed) further construction of the shopping complex.
The decision of the district forum has been upheld by the Hon'ble STATE COMMISSION Lucknow.

The affected tower buildings Ferrara and Milano are now occupied. The possession to these affected towers has been given by Mahagun without even getting FIRE NOC from chief fire officer Ghaziabad. This is against the law and will be challenged in court in due course. But the more important matter is that YOU THE CURRENT RESIDENTS OF MILANO AND FERRARA HAVE BEEN EXPOSED TO GRAVE DANGER. For the sake of saving penalty amount the builder has irresponsibly given possession without getting the clearance. This means that if an accident occurs in the building the statutory government authorities cannot be held responsible. The authorities will simply raise their hand-up and deny any responsibility whatsoever. You have taken possession at your own risk when NOC has not been given by authority. Hence you and only you shall be responsible for any accident such as a fire tragedy.

Mahagun is treating me with vengeance. Instead of accepting his mistake and rectifying it Mahagun has decided to hurt me. He has shamelessly withheld my flat and has threatened to never handover my flat. Is this the way to redress grievance? Can't we the conman man not even have the right to demand a safe environment to live in?
Mahagun thinks that by blackmailing me he can force me into withdrawing me complaint. But he is wrong. Mahagun is 'shooting the Messenger'. Is it wrong to avert a fire tragedy? Is it wrong to protest public endangerment?
Mahagun has forgotten that he is not just hurting 1 person but by constructing the illegal shopping complex Mahagun has jeopardized the life safety of 1200 innocent people. SHOPPING COMPLEX IS A DEATH SENTENCE TO THE RESIDENTS OF MILANO AND FERRARA, there is no doubt about that. People have a right to now that they are living in danger.

I request you to read my post carefully and try to understand the gravity of the problem. In India the cost of human life is cheap. HINDUSTAN ME INSAAN KI JAAN KI KEEMAT VIDESH KE KUTTE SE KUM HOTI HAI. THE COST OF HUMAN LIFE IN INDIA IS LESS THAN A DOG'S. I had to right these words in utter disgust. What should have been done by the authority is being done by me at a huge cost on my finances and my health. Tragedies don't come with a warning, please be vigilant and prepared.

@Soft, Ansal project you have mentioned is one of the most delayed project, as far I know.. and believe me it was offered to me when I had booked Mahagunpuram... Now Mahagunpuram is about to complete , whereas this project is still to see the light of the day.
